1.1 - "SmallWeb", "We", "us" or "our" means Cloud2Z Limited (trading as "SmallWeb"), a company registered in England and Wales under company number 12272693 and with registered office at 27 Old Gloucester Street, London, United Kingdom, WC1N 3AX. We also operate and are available through our main https://cloud2z.com brand.
1.3 - We reserve the right to amend these Terms of Service at any time. Any and all amendments to these Terms of Service will be available to view on the Website.
2.2 - You may not open multiple personal accounts under any circumstances. You must have the authority to act on behalf of any business listed within your account.
3.1 - Invoices for monthly services will be issued 10 days in advance of their due date.
3.2 - We accept payments via PayPal, BitPay (Cryptocurrency) and via Bank Transfer.
3.3 - Unpaid services will be suspended 1 (one) days past their due date.
3.4 - Unpaid services will be terminated 7 (seven) days past their due date.
3.5 - Orders unpaid for more than 24 hours are automatically removed from the system.
4.1 - SmallWeb offers a 30 (thirty)-day-money-back guarantee for new hosting registrations.
4.2 - Refunds are not offered for domain registrations, software licenses, or IP addresses.
4.3 - No refund will be provided it the service has been used to violate our Terms of Service.
4.4 - Bitcoin payments are not eligible for refunds.
5.1 - Chargebacks or disputes against any payment will result in immediate suspension of all services on the account until the dispute is removed, and the account prohibited from placing any further orders. We may terminate the account if a chargeback or dispute is unresolved.
6.1 - SmallWeb is happy to provide you with 99.9% uptime excluding planned maintenance.
6.2 - Uptime is considered when the server you are hosted on is accessible via IP.
6.3 - This SLA does not cover downtime due to any mistakes on your behalf or suspension.
6.4 - In the event that this SLA is breached, we will refund up to 10% of your monthly or annual service fees or offer you extended service.
6.5 - Refund requests must be submitted through a ticket to support department or via email.
7.1 - You agree that any violations listed in this Acceptable Usage Policy are considered prohibited and may result in immediate account suspension and/or termination.
send unsolicited or bulk email, marketing emails, or spam emails to any party.
access or attempt to access a computer or network illegally or without consent.
distribute, link to, or make available in any way to intellectual or copyrighted content that you do not have the rights to.
store, transmit or create ANY media suggesting a human or humans that are under the age of 18 years in either an implied or actual pornographic scenario.
forge email headers or TCP/IP packet headers or engage in spoofing.
abuse the resource limits of hardware in a way that negatively impacts others.
distribute worms, keyloggers, viruses, malware, Trojans or other harmful media.
commit or attempt to commit any denial of service (DoS) attack against any computer, network, or individual.
8.1 - We do not warrant that the Services will meet your individual requirements. We are not responsible for any people, equipment, deliverables or services that we are not expressly stipulated to provide in these Terms. You are responsible for any people, equipment, deliverables and services that you need to obtain from someone else.
8.2 - If you are a Business Customer, you shall indemnify and hold us harmless against all liabilities, costs, expenses, damages and losses (including direct or indirect consequential losses, loss of profit, loss of reputation and all interest, penalties and legal and other reasonable professional costs and expenses) suffered or incurred by us arising out of or in connection with any breach by you of our Terms of Service. This indemnity shall apply whether or not you have been negligent or at fault.
