1.0 - INTRODUCTION

1.1 - "SmallWeb", "we”, "us" or "our" means SmallWeb Ltd, a company registered in England and Wales under company number 12272693 and with a registered office address located at 27 Old Gloucester Street, London, United Kingdom, WC1N 3AX. 1.2 - These Terms of Service govern your submission of an order to us for our provision of services to you through smallweb.net (the "Website") and your registration for an account on the Website to manage services. By registering on the Website, you agree to be legally bound by these Terms of Service.

1.3 - We reserve the right to amend these Terms of Service at any time. Any and all amendments to these Terms of Service will be available on the Website.


2.0 - YOUR ACCOUNT

2.1 - You must provide information that is accurate and complete at all times. We process your personal information in accordance with our Privacy Policy.

2.2 - You may not open multiple personal accounts under any circumstances and you must have the authority to act on behalf of any associated business.


3.0 - SERVICE BILLING

3.1 - We accept payment via: Cryptocurrency, PayPal (Credit & Debit Card) and UK Bank Transfer. PayPal payments must originate from a verified account.

3.2 - Overdue services are taken offline and “suspended” after 1 day of non-payment. They are permanently “terminated” 7 days after invoice non-payment.


4.0 - REFUND POLICY

4.1 - SmallWeb offers a 30 (thirty)-day-money-back guarantee for new hosting services.

4.2 - Refunds can only be claimed for hosting services paid for at their original full pricing.

If you have a promotional plan or a discounted pricing rate you may not claim a refund.

4.3 - Refunds are not offered for domains, licenses, IP addresses or other related addons.

4.4 - Refunds are not offered for payments made with cryptocurrency through any wallet.

4.5 - No refund will be provided if the service has been used to violate our Terms of Service.


5.0 - CHARGEBACKS

5.1 - Chargebacks or disputes against any payment made to SmallWeb will result in the immediate suspension of all services on the account. If a resolution is not reached within 48 hours, the related service and all other services on the account will be terminated.

5.2 - Threats/implications regarding creating a payment chargeback will result in termination.


6.0 - UPTIME LEVELS

6.1 - SmallWeb aims to provide a 99.9% uptime rate for web services (http, ftp and network).

6.2 - SmallWeb aims to provide a 99.9% uptime rate for mail services (pop, imap and smtp).

6.3 - We will send a notification In the event of 30 minutes or more unplanned downtime.

6.4 - We provide compensational credit or additional service strictly on a case by case basis.


7.0 - USAGE POLICY

7.1 - Our web hosting services are aimed for users wanting to publish a website. While email services are enabled, there is a daily outbound limit of 100 emails.

7.2 - Our email services are aimed for users wanting to host and manage their own email without a website. There is an hourly outbound limit of 300 emails.

7.3 - The following uses are considered prohibited. You agree NOT to use our services to:

send unsolicited emails, marketing emails, or spam emails to any party.
send bulk email, solicited or unsolicited to any party whatsoever.
access or attempt to access a computer or network illegally or without consent.
forge email headers or TCP/IP packet headers or engage in spoofing.
distribute worms, keyloggers, viruses, malware, Trojans or other harmful media.
commit or attempt to commit any denial of service (DoS) attack against.
distribute or link to intellectual/copyrighted content without the correct licensing.
abuse the resource limits of hardware in a way that negatively impacts others.


8.0 - DOMAIN NAMES

8.1 - We will send a renewal notice of any due domain names 60 and 30 days in advance.


9.0 - INDEMNITY CLAUSE

9.1 - We do not warrant that the Services will meet your requirements. We are not responsible for any people, equipment, or services that we are not expressly stipulated to provide in these Terms. You are responsible for any people, equipment, deliverables and services that you need to obtain from someone else.

9.2 - If you are a Business Customer, you shall indemnify and hold us harmless against all liabilities, costs, expenses, damages and losses direct or indirect losses, loss of profit, loss of reputation and all interest, penalties and legal and other reasonable professional costs and expenses) suffered or incurred by us arising out of or in connection with any breach by you of our Terms of Service. This indemnity shall apply whether or not you have been negligent or at fault.
